I was physically and mentally abused for many years, finally one week ago I left and my family won’t speak to me saying that I abandoned my marriage. Is this abandonment?

I was in a marriage for 20 years, my wife was both physically and mentally abusive towards me the entire time. I simply could no longer take the abuse, and I moved out of the marital home. Now my entire family is refusing to speak with me, the telling me that I abandoned my wife, who is abusing me. In my legally wrong and leaving the home? In my at fault and will be held responsible?

ANSWER:

I’m sorry to hear about your family not talking to you over this matter, but that actually has no bearing on the case that point. As far as being legally wrong for leaving the home or being held responsible, the courts no longer look at things such as this. It could be used as evidence, if your wife file divorce against you, she could use this as the reason being abandonment. The courts no longer care about such things as far as issues of child custody, alimony, division of assets or other traditional divorce situations. The simple fact is the marriage was over, and you moved out. The courts will take into account, the abuse he suffered, but it’s not gonna hold the way it once did in the past.
