I-751 RFE: What USCIS Is Actually Asking For
Quick answer
An I-751 request for evidence (RFE) is not a denial. It means the officer cannot yet conclude from your file that the marriage was entered into in good faith. Since USCIS Policy Alert PA-2026-05 (August 5, 2026), an RFE can give up to 12 weeks plus 3 days for mailing, but the notice may give less, so the date printed on your notice controls, and there are no extensions. Answer every numbered item with evidence covering every year of the marriage, explain anything that does not exist, and send one complete package, because USCIS treats even a partial response as a request for a decision.

A letter came from immigration, and somewhere on it, it says request for evidence. Somewhere on that page there is a date. That date is the most important thing in the envelope, more important than the list of documents, because if you miss it, none of the rest matters.

What is an I-751 request for evidence?

A request for evidence is not a denial, not an accusation that you are lying, and not a sign that your marriage is under investigation. It means the officer looked at your file and cannot conclude yet from what is in front of them. On Form I-751, the question is whether the marriage was entered into in good faith: not whether it lasted or was happy, but whether it was real when it began. Often, the documents you sent simply did not cover the years the officer wanted to see.
How long do I have to respond to an I-751 RFE?

Under the regulations, an RFE can give you up to 12 weeks to respond, plus 3 days when the notice is mailed. That is where the "87 days" you may have read about comes from. But under USCIS Policy Alert PA-2026-05, issued August 5, 2026, 12 weeks is the maximum, not a guarantee, and your notice may give you less. The policy also removed the extra 14 days USCIS used to add for notices mailed outside the United States.
- The deadline printed on your notice controls.
- It runs from the date on the notice, not the day you opened the envelope.
- USCIS does not grant extensions. No form or phone call adds time.
- If your response is not received in time, the officer decides on the file as it stands, which usually means a denial.
RFE or notice of intent to deny?

Read the heading. A notice of intent to deny (NOID) is more serious, and its response time can be no more than 30 days (plus 3 days if mailed). Read the deadline on whichever notice you have; do not assume.
Is my status safe while the I-751 is pending?
Yes. When you file Form I-751, USCIS sends a Form I-797C receipt notice that extends your conditional permanent resident status for 48 months past the expiration date on your green card. Your expired card together with that receipt is your proof of status. Keep them together where you can find them in 10 seconds.
How do I read the notice?
Read it slowly and look for 2 things. First, what time period? Officers often are not asking about your whole marriage, but about one gap, one year where the file went quiet. Second, what category? Financial life together, where you live, who knows you as a couple: documents that show a shared life, not just a shared address.
Sometimes the notice asks for something you already sent. It is not a trick. Send it again, point to where it was in the original filing, and do not argue about it.
What if we do not have joint financial documents?
Plenty of real marriages do not look the way a form expects. One spouse handles all the money, one has no credit history, you live with family with no lease in your names, or someone works in cash. None of that means your marriage is not real.
The principle: if a document does not exist, say so, say why, and put something else in its place. Silence on a requested item is what turns into a denial. Alternatives can include:
- Photographs across years, not one afternoon
- Messages between the two of you over time
- Travel together
- Medical records listing each other
- Insurance, beneficiary designations, and a shared phone plan
- Signed letters from people who know you both, with their contact information and specific things they have seen
Build it across every year of the marriage, not just the strongest year, and date everything. If you have 4 categories and 5 years of marriage, the officer should see all 5 years in each category, or see why they cannot.
How do I put the response together?

- Follow the notice's instructions exactly, including the page it tells you to put on top and the address to use.
- Cover letter: number the items the way the notice numbers them. Item 1, here is the document that answers item 1. Item 3 does not exist, here is why, and here is what we have instead.
- Translations: any document not in English needs a complete English translation with the translator's certification. An uncertified translation is the same as not sending the document.
- One complete package: USCIS treats any response, even a partial one, as a request to decide the case on what you sent. There is no second chance to add the rest later.
- Send it with tracking and build in time. What matters is when it arrives, not when you mailed it.

Common mistakes

- Counting the days from when the letter arrived
- Assuming 87 days without reading the notice
- Sending 400 pages and hoping volume answers the question
- Leaving a requested item unanswered
- Writing a long complaint about the request
- Mailing pieces as you find them
What happens after I respond?
The officer can approve the petition, schedule an interview, or, if the response still does not resolve it, issue a notice of intent to deny (a second, shorter chance to answer) or in some cases deny. An RFE adds time, often a couple of months at minimum, because the case goes back into the queue. That is normal and is not a signal about the outcome.
Divorced or divorcing after filing jointly?
If you filed jointly and the marriage has ended or is ending, USCIS may send an RFE asking for your final divorce decree, and the joint petition is then treated as a request for a waiver. That changes which rules apply and what you must prove. Do not answer that notice on instinct.
When should I get help?
Some notices ask for one clean document you already have. Send it and move on. But if the notice questions the good faith of the marriage, asks for something that does not exist, your circumstances have changed since you filed, or you cannot tell what it is asking for, the cost of getting it wrong is the petition itself. Protect your case from notario fraud
Do not hand an RFE to a notario or to anyone who is not a licensed attorney or a DOJ-accredited representative. In the United States, a notary public is not a lawyer.
Frequently asked questions
How many days do I have to respond to an I-751 RFE?
Follow the deadline printed on your notice. Since August 5, 2026, USCIS treats 12 weeks (plus 3 days if mailed) as a maximum, and a notice may give less. There are no extensions.
Is an I-751 RFE a denial?
No. It means the officer needs more evidence before deciding whether the marriage was entered into in good faith.
Can I get more time to respond to an RFE?
No. USCIS regulations do not allow additional time to respond to an RFE or a notice of intent to deny.
Can I send part of my response now and the rest later?
No. USCIS treats any response, even a partial one, as a request for a decision on what was sent. Send one complete package.
What if we do not have a joint bank account?
Say so, explain why, and send other evidence of a shared life across every year of the marriage, such as photos, messages, travel, medical records, insurance, and specific signed letters from people who know you.
Is my status valid while my I-751 is pending?
Yes. Your Form I-797C receipt notice extends your conditional resident status for 48 months past the date on your green card. Keep the card and receipt together.
