Massachusetts law is very clear that any pension received by one spouse during the marriage should be split 50-50 with the other spouse. This can be agreed upon differently in a divorce settlement, but you are entitled to half of the pension. It’s important to remember that this is half of the pension for the duration of your marriage, not the entire pension itself, as your husband worked for 30 years and you were married for 20. You are entitled to 20 years’ worth of pension.
